# Terms of Service

Welcome to Loved Already Club. These Terms of Service ("Terms") govern your access to and use of alreadyloved.club and any related services (the "Site"), operated by MESSIA INC., a California corporation doing business as Loved Already Club ("we," "us," or "our"). By accessing the Site or placing an order, you agree to these Terms.

## 1. Eligibility

You must be at least 18 years old, or have parental consent, to use this Site or place an order. By placing an order, you represent that you meet this requirement and that all information you provide is accurate.

## 2. Products

Every piece offered on the Site is **one-of-one vintage** or pre-owned. Because each item is unique, we make every effort to photograph and describe condition accurately, including any flaws, repairs, or signs of wear consistent with age. However:

- Colors may vary slightly between your screen and the physical item
- Measurements are taken by hand and are approximate (±½ inch)
- Vintage sizing does not conform to modern sizing — please rely on listed measurements, not tag size
- All pieces are sold "as is"; minor signs of age and wear are inherent to vintage goods and are not considered defects

## 3. Orders & pricing

Placing an order constitutes an offer to purchase. We reserve the right to accept, refuse, or cancel any order at our discretion, including orders that appear fraudulent, where product is unavailable, or where pricing is incorrect due to error.

All prices are listed in US dollars. Prices and availability are subject to change without notice. Sales tax is applied where required by law.

## 4. Payment

Payment is processed through Shopify Payments and other approved third-party processors. By providing payment information, you authorize us (and our processors) to charge the full order amount, including taxes and shipping.

## 5. Shipping & risk of loss

Shipping terms are described in our Shipping Policy. Title and risk of loss pass to you once the package is delivered to the carrier.

## 6. Returns

Returns are accepted only under the conditions described in our Refund & Return Policy.

## 7. Intellectual property

All content on the Site — including photography, product descriptions, graphics, logos, and the "Loved Already Club" and "already loved club" brand names — is owned by or licensed to MESSIA INC. You may not reproduce, distribute, or use any content without our prior written permission, except as necessary to browse and purchase.

## 8. User content

If you submit reviews, photos, comments, or other content to the Site or tag us on social media, you grant Loved Already Club a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content for promotional purposes, with or without attribution, unless otherwise agreed in writing.

## 9. Prohibited conduct

You agree not to:

- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to the Site, its servers, or any related systems
- Resell, scrape, or redistribute product listings or content
- Use bots, scripts, or other automated means to place orders

## 10. Disclaimers

The Site and all products are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are prohibited by applicable consumer protection law.

## 11. Limitation of liability

To the maximum extent permitted by law, in no event shall MESSIA INC., its officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or any product purchased, whether based on warranty, contract, tort, or any other legal theory. Our total liability for any claim shall not exceed the amount you paid for the specific product giving rise to the claim.

## 12. Indemnification

You agree to indemnify and hold harmless MESSIA INC. and its affiliates from any claim, liability, or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your use of the Site, or your violation of any law or third-party right.

## 13. Governing law & dispute resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

## 14. Changes

We may update these Terms at any time. The "Effective date" above reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the revised Terms.
